Agreement with property owner to dedicate twenty foot utility easement on west side of North Elk Vale Road from north edge of City Lift Station Property to south edge of Sports Complex Property and to waive the collection of base size construction fees. Negotiations with the property owner, DTH, LLC, included discussions regarding base utility size construction fees and oversize construction fees. The property owner has agreed to donate the necessary easements as long as the base utility construction fees are waived. This arrangement is consistent with the current practice of not collecting base utility costs for developers (Soccer Rapid City, Vision Fund) that extend infrastructure to reach their property. The City has reserved its right to collect the oversize construction fees on this property. |
